These Terms and Conditions ("Terms") apply to your use of bestperformancesystems.com and Live Pain Free LLC and to the programs, workshops, resources and messages provided by Best Performance Systems ("Best Performance Systems", "we", "us" or "our"). By using our website or buying from us, you agree to these Terms.

Our Services

Best Performance Systems provides safety, health and leadership training for workplaces. This includes online training programs, supervisor leadership training, soft skills workshops taught over Zoom, consultations online, contracted live services on the client's site, and free resources. Program details, prices and what's included are described on the relevant sales or checkout page.

Accounts and Access

Some programs are delivered through our online course platform. You are responsible for keeping your login details safe. Program access is licensed to your company for the period stated at purchase (for example, 12 months) and may not be resold or shared outside your organization without written authorization from Best Performance Systems.

Payments and Renewals

Prices are shown at checkout in US dollars. Payment is due at the time of purchase unless we agree on other terms in writing, such as an invoice for ACH or check payment. Where a program renews, the renewal price and terms are shown on the sales page, and we will remind you before your renewal date.

Guarantee and Refunds

Our guarantee and refund conditions are described on the program's sales page. To request a refund under the guarantee, email [email protected] within the time stated there. Eligibility is based on the training and leadership session activity recorded in your program account. Except as stated in the guarantee, payments are non-refundable.

Intellectual Property

All content we provide, including videos, documents, routines, workshop materials and website content, belongs to Best Performance Systems. It is licensed to you for use within one location of your organization only. You may not copy, sell, publish or distribute it without our written permission. If you wish to share our materials with another location in your organization, this can be arranged at a discount. Contact us for details. Any routines provided specifically as free routines may be shared with your team, friends and family for personal use.

Health and Safety Disclaimer

Our training and routines are educational and are not a substitute for medical advice. Anyone with an injury, pain or a medical condition should check with a qualified health professional before starting any exercise or stretching routine. Each organization remains responsible for its own workplace safety practices and legal compliance.

Best Performance Systems sends appointment reminders and follow-up text messages to people who book a consultation call and opt in on our booking form.

Limitation of Liability

To the fullest extent allowed by law, Best Performance Systems is not liable for any indirect, incidental or consequential damages arising from use of our website, programs or materials. Our total liability for any claim is limited to the amount you paid us for the program or service in question.
